The laws surrounding New Zealand Citizens becoming Australians can be complicated due to regulation changes over time. 

It is noted that the definition of ‘eligible New Zealand Citizen’ must be interpreted correctly. This is because we New Zealand Citizens living in Australia may or may not be classified as an ‘eligible New Zealand Citizen”. 

Eligible New Zealand citizen

If you were in Australia on 26 February 2001 on a SCV, spent at least 12 months in Australia on a SCV in the 2 years immediately before 26 February 2001, orhave a Centrelink certificate from before 26 February 2004 that shows you were living in Australia, then you may be an eligible New Zealand Citizen. 

If so, then may be eligible to apply for Australian Citizenship. It is noted that you must provide evidentiary proof in order to be successful in your Australian Citizenship Application. If you are uncertain as to how to show proof, please contact us. 

After 26 February 2001 

If you arrived in Australia after 26 February 2001, then you will not be eligible for Australian Citizenship straightaway. You must first become an Australian permanent resident, after which you can apply for Australian Citizenship when eligible. 

There are over 200 types of visas in Australia including skilled, work, family and other types of visas.

Why become an Australian Citizen? 

In our experience, we have seen countless numbers of New Zealand friends and clients who were sent back to their home country. Some of the visa holders have been living in Australia most of their life (some over 30 years and had little to do with their home country). Their families, livelihood and jobs are here in Australia. Cancellation of visa can occur usually based on character issues. 

Therefore, it is important to secure your permanent residency and Australian Citizenship especially if Australia is home.

Subclass 461 Visa 

If you hold a passport other than New Zealand or Australian passport and have a partner who is a New Zealand Citizen living in Australia who is not an eligible New Zealand Citizen, then you may be eligible to apply for a Subclass 461 family visa. 

Upon grant, this visa will enable you to live, work and study in Australia for up to 5 years.
