Subclass 188 Visas 

​

Subclass 188 Visas has various streams as below. 

​

  1. Business Innovation stream

​

This provisional visa is for people with business skills. The visa is usually granted up to 4 years and 3 months, with option to extend in certain circumstances. It is a provisional visa which leads to Permanent Residency if the visa holder meets the provisional visa requirement. 

 

Generally, to be eligible for this visa, an applicant must score at least 65 points on the points test (this can include English, qualification, business asset, business experience, etc). The applicant must already have an existing business which turns over more than $500,000 AUD for at least 2 years in the last 4 years before applying and have a minimum of at least $800,000 AUD assets (net) available to transfer to Australia upon the grant of the provisional visa. 

 

After the visa is granted, the visa holder must operate a new or existing business in Australia and meet specific requirements and if this is met, then the visa holder can apply for Permanent Residency. 

 

It is noted that an applicant must be nominated by a State or Territory Government in Australia for this visa.

2. Investor Stream 

 

This provisional visa is for people with business and investment skills. The visa is usually granted up to 4 years and 3 months. It is a provisional visa which leads to Permanent Residency if the visa holder meets the provisional visa requirement. 

 

This provisional visa requires the visa holder to invest at least AUD1.5 million in an Australian State or Territory and maintain business or investment activity in Australia for a specified period of time, and after completing same, the visa holder may be eligble to apply for Permanent Residency. 

 

Generally, to be eligible for this visa, an applicant must score at least 65 points on the points test (this can include English, qualification, business asset, business experience, etc). The applicant must already have a existing investments which are successful. The applicant must also have assets (net) of at least AUD 2.25 million. 

 

It is noted that an applicant must be nominated by a State or Territory Government in Australia for this visa.

3. Significant Investor stream

​

This provisional visa is for people who invest at least AUD5 million in Australia and maintain investment activity in Australia. Only specified investments are applicable. Visa Applicant must be nominated by an Australian State or Territory or Austrade. The visa is granted for up to 4 years with the option toward permanent residency if eligible. The benefit of this visa is that visa holders can choose to invest in broader range of investments in Australia. Unlike the Investor Stream (1.5 mil), this visa stream is not points tested which provides a greater flexibility with age, language and other requirements. Visa Applicant must be nominated by State or Territory. 

 

 

This visa provides a pathway towards permanent residency.

4. Premium Investor stream

 

This provisional visa is for people who are nominated by Austrade and who invest at least AUD15 million in Australian investments and/or philanthropic contributions. This visa stream is not points tested which provides a greater flexibility with age, language and other requirements. This visa provides a a pathway towards permanent residency.

5. Entrepreneur stream

​

This provisional visa is for people with entrepreneurial skills. The visa is usually granted up to 4 years and 3 months. It is a provisional visa which leads to Permanent Residency if the visa holder meets the provisional visa requirement. 

 

Generally, to be eligible for this visa, an applicant must have a funding agreement with a third party of at least $200,000 AUD to carry out entrepreneurial activities in Australia. Visa Applicant must also be nominated by an Australian State or Territory and will be required to meet English requirement as well as provide a business plan.

Business Innovation and Investment (Permanent) visa (subclass 888)

 

This visa has various streams and the relevant stream will depend on which visa you hold during the provisional stage. If you are a Subclass 188 visa holder and have met the requirement of your visa, then you may be eligible to apply for a permanent visa.

Business Talent (Permanent) visa (subclass 132)

Subclass 132 visa has two streams as below.

  1. Significant Business History stream 

​

This is a permanent visa is for people with significant business skills with successful business history. 

 

Generally, to be eligible for this visa, an applicant have a net value of at least $1.5 million AUD, annual turnover of at least AUD 3 million for 2 out of the last 4 fiscal years before applying, and a total net assets of at least $400,000 ownership interest (2/4 years before applying).  

 

Visa holder will then be required to operate a new or existing business in Australia.

 

It is noted that an applicant must be nominated by a State or Territory Government in Australia for this visa.

 2. Venture Capital Entrepreneur stream

​

This visa stream is a permanent resident visa. An eligible application must prove that they have sourced venture capital funding from a member of the Australian Investment Council (AIC) (formerly known as the Australian Private Equity and Venture Capital Association Limited (AVCAL) of at least AUD1 million. State or Territory Nomination is required.
